ข้อกำหนดและเงื่อนไขการใช้เว็ปไซต์
ข้อสำคัญ
ขอขอบพระคุณการเข้าเยี่ยมชมเว็ปไซต์ของเรา www.biotherm.co.th (“เว็ปไซต์”) ขอท่านได้โปรดอ่านข้อกำหนดและเงื่อนไขฉบับนี้ (“ข้อกำหนดการใช้”) ก่อนการใช้งานเว็ปไซต์ซึ่งดำเนินการโดย บริษัท ลอรีอัล (ประเทศไทย) จำกัด เลขที่ 179 อาคารบางกอกซิตี้ทาวเวอร์ ชั้น 6, 8 และ 9 ถนนสาทรใต้ แขวงทุ่งมหาเมฆ เขตสาทร กรุงเทพมหานคร ประเทศไทย 10120 (“บริษัทฯ”) โดยการใช้งานเว็ปไซต์นี้ ท่านได้ยอมรับข้อกำหนดการใช้ที่บริษัทฯเป็นผู้ให้บริการการเข้าใช้งานแก่ท่าน บริษัทฯอาจเปลี่ยนแปลงข้อกำหนดการใช้ฉบับนี้ได้เป็นครั้งคราว ดังนั้นขอให้ท่านได้โปรดทำความเข้าใจข้อกำหนดการใช้ทุกครั้งที่มีการใช้งานเว็ปไซต์ การใช้งานของท่านบนเว็ปไซต์นี้ทั้งนี้ท่านจำต้องปฏิบัติตามการเปลี่ยนแปลงในข้อตกลงและผูกผันตนกับข้อกำหนดการใช้ทุกครั้งที่มีการเปลี่ยนแปลง หากเวลาใดก็ตาม ท่านไม่ประสงค์จะยอมรับในข้อกำหนดการใช้นี้ ท่านก็ไม่อาจจะใช้งานเว็ปไซต์นี้ได้
การไม่รับประกันรับรอง
ทั้งนี้ อาจปรากฏลิงค์ที่จะนำท่านออกไปจากเว็ปไซต์นี้ หรือ นำท่านเข้ามาสู่เว็ปไซต์นี้จากเว็ปไซต์ของบุคคลที่สาม ลิงค์ของบุคคลที่สามนั้นมิได้อยู่ในความควบคุมของบริษัทฯ และบริษัทฯไม่มีความรับผิดชอบในเนื้อหาที่ปรากฏของลิงค์ดังกล่าว หรือลิงค์อื่นใดที่บรรจุไว้ในเวปลิงค์เหล่านั้นทั้งสิ้น
ลิงค์ของบุคคลที่สามที่ปรากฏอยู่บนเว็ปไซต์นี้ บริษัทฯมิได้เป็นผู้สลักหลังหรือเป็นผู้รับผิดชอบในเว็ปไซต์ ผลิตภัณฑ์ หรือ บริการของลิงค์ปรากฏเหล่านั้น ขอบเขตที่เว็ปไซต์นี้บรรจุลิงค์เพื่อไปสู่เว็ปไซต์อื่น หรือการเข้าสู่เว็ปไซต์นี้จากลิงค์ที่ปรากฏบนเว็ปไซต์อื่นนั้น เป็นเนื้อหาและสิ่งที่ปรากฎที่บริษัทไม่สามารถควบคุมได้ ข้อกังวลเกี่ยวกับการให้บริการ หรือแหล่งข้อมูลของลิงค์นั้นๆ เป็นภาระหน้าที่ของผู้ให้บริการ หรือ แหล่งข้อมูลภายนอกทั้งสิ้น
ทรัพย์สินทางปัญญา
เวปไซต์นี้ รวมถึง ข้อความ เนื้อหา ซอฟท์แวร์ วีดิโอ ดนตรี เสียง กราฟฟิก รูปภาพ งานแสดง งานศิลปะ ภาพวาด ชื่อ โลโก้ เครื่องหมายการค้า เครื่องหมายบริการ หรือวัสดุอื่นๆ (“เนื้อหา”) ได้รับความคุ้มครองโดย สิทธิในลิขสิทธิ์ เครื่องหมายการค้า และ/หรือ สิทธิในกรรมสิทธิ์อื่นๆอยู่แล้ว เนื้อหาให้รวมถึง เนื้อหาที่บริษัทฯเป็นเจ้าของและเนื้อหาที่ควบคุมโดยบริษัทฯ ตลอดจนเนื้อหาที่เป็นเจ้าของ หรือ ถูกควบคุมโดยบุคคลที่สาม และได้รับอนุญาตจากบริษัทฯแล้ว บทความ รายงาน หรือองค์ประกอบอื่นใดของส่วนบุคคลทั้งหมดที่ถูกตกแต่งลงบนเว็ปไซต์อาจเป็นงานที่มีลิขสิทธิ์ ท่านตกลงยอมรับที่จะยอมปฏิบัติตามการบอกกล่าวเรื่องของลิขสิทธิ์ หรือ ข้อจำกัดการใช้ที่มีอยู่ในเว็ปไซต์ตามส่วนที่เพิ่มเติมทั้งหมด
ท่านมิอาจใช้เครื่องหมายการค้า หรือ ชื่อทางการค้าใดๆโดยมิได้รับอนุญาตล่วงหน้าเป็นลายลักษณ์อักษรจากบริษัทฯได้ทั้งสิ้น และท่านรับทราบว่าท่านมิได้เป็นเจ้าของกรรมสิทธิ์ใดๆในชื่อและเครื่องหมายดังกล่าวทั้งหมดทั้งสิ้น
ท่านตกลงยอมรับว่าจะแจ้งให้บริษัทฯทราบเป็นลายลักษณ์อักษรโดยทันที เมื่อท่านพบเห็นการเข้าถึงโดยไม่ได้รับอนุญาต หรือ การใช้เว็ปไซต์โดยผู้หนึ่งผู้ใด หรือ ข้อร้องเรียนเว็ปไซต์หรือเนื้อหาของเว็ปไซต์ไปละเมิดสิทธิในลิขสิทธิ์ เครื่องหมายการค้า หรือสิทธิตามสัญญา สิทธิตามประมวลกฎหมาย หรือ สิทธิตามกฎหมายจารีตประเพณีของคู่สัญญาอื่นใด
การให้อนุญาตและสิทธิการดาวน์โหลด
ท่านมิได้รับสิทธิ หรือ ได้รับอนุญาตในการใช้งานเว็ปไซต์ และ/หรือ เนื้อหานอกเหนือไปจากสิทธิการใช้งานเว็ปไซต์ที่ได้จำกัดไว้ตามที่กำหนดไว้ในข้อกำหนดการใช้และเงื่อนไขการดาวน์โหลดตามข้อนี้ นอกจากนี้ท่านยังมิอาจลอกเลียน ทำซ้ำ เรียบเรียงใหม่ แปลกลับ ถอดประกอบ วิศวกรรมย้อนรอย จัดจำหน่าย เผยแพร่ จัดแสดง นำเสนอ เปลี่ยนแปลง โหลดขึ้นเพื่อนำไปเป็นผลงานใหม่ ถ่ายทอด หรือไม่ว่าวิธีการใดๆอันเป็นการใช้ประโยชน์จากส่วนใดส่วนหนึ่งของเว็ปไซต์
การดาวน์โหลดสามารถกระทำได้โดยได้รับอนุญาตจากบริษัทฯ หากเป็นกรณีดังนี้
- (ก) ท่านมิได้กระทำการใดๆมากกว่าการปริ้นสำเนาหนึ่งชุดสำหรับการดาวน์โหลดนั้น และมิได้กระทำการใดๆต่อกับสำเนางานนั้น
- (ข) ท่านทำขึ้นเพื่อการใช้ส่วนตัวเท่านั้น มิใช่เพื่อการใช้งานทางพาณิชย์สำหรับการดาวน์โหลด และ/หรือ การสำเนาเหล่านั้น และ
- (ค) ท่านเก็บรักษางานที่ได้ดาวน์โหลดนั้น และ/หรือ สำเนางานนั้นตามข้อกำหนดลิขสิทธิ์แล้ว และท่านยอมตนผูกพันตามข้อกำหนดลิขสิทธิ์นั้นด้วย นอกจากนี้ท่านไม่อาจเสนอเพื่อขาย หรือ ขาย หรือ จัดจำหน่ายผ่านสื่ออื่นใด (รวมถึงการจัดจำหน่ายผ่านทางรายการโทรทัศน์ วิทยุกระจายเสียง หรือ การจัดจำหน่ายบนเครือข่ายคอมพิวเตอร์) ในเนื้อหา หรือ ส่วนหนึ่งส่วนใดของเวปไซต์ได้ ท่านไม่อาจทำส่วนหนึ่งส่วนใดของเว็ปไซต์ให้ปรากฏเป็นส่วนหนึ่งของเว็ปไซต์อื่นๆได้ ไม่ว่าจะเป็นการทำลิงค์เชื่อมโยง (HYPERLINK) บนอินเทอร์เน็ต หรือ วิธีการอื่น เว็ปไซต์และข้อมูลที่ปรากฏบนเว็ปไซต์นั้นมิอาจนำมาใช้เพื่อเป็นฐานข้อมูลไม่ว่าลักษณะใดก็ตาม และไม่อาจนำเว็ปไซต์มาเก็บไว้เป็นฐานข้อมูล (ไม่ว่าทั้งหมดหรือบางส่วน) เพื่อประโยชน์ในการเข้าใช้งานโดยท่าน บุคคลอื่น หรือ เพื่อจัดจำหน่ายฐานข้อมูลที่เว็ปไซต์บรรจุไว้ไม่ว่าทั้งหมดหรือบางส่วนของเว็ปไซต์
การไม่รับรอง
เว็ปไซต์และเนื้อหาได้จัดทำขึ้น ตามรูปแบบ “ตามที่ปรากฏ” ปราศจากการรับรองในทุกรูปแบบใดก็ตาม ไม่ว่าอย่างชัดแจ้ง หรือ โดยปริยาย ตามขอบเขตที่กว้างที่สุดเท่าที่กฎหมายจะสามารถอนุญาตให้ได้รวมการไม่รับรองในความเป็นเจ้าของ ความสามารถในการซื้อขายในตลาดได้ คุณภาพความพึงพอใจ ความเหมาะสมกับวัตถุประสงค์เพื่อการนั้นๆ และไม่ได้รับรองว่าปราศจากการละเมิดสิทธิความเป็นเจ้าของของคนอื่นๆ หรือบุคคลที่สามแต่อย่างใด บริษัทฯขอปฏิเสธความรับผิดชอบ หรือความรับผิดตามกฎหมายเกี่ยวกับระบบปฏิบัติการของเว็ปไซต์ และไม่ขอรับรองว่าเว็ปไซต์จะทำงานได้อย่างไม่ขัดข้อง ปราศจากความผิดพลาดหรือ ข้อขัดข้องที่ต้องได้รับการแก้ไขใดๆ ขอท่านได้โปรดเข้าใจว่าในบางเขตอำนาจนั้นไม่อนุญาตให้การยกเว้นความรับผิดโดยปริยายเบื้องต้นนั้น บังคับใช้ได้ ดังนั้นบางส่วนหรือทั้งหมดของข้อยกเว้นเบื้องต้นนั้นอาจจะไม่สามารถใช้บังคับกับท่านก็เป็นได้
บริษัทฯไม่รับรองว่าเว็ปไซต์จะสามารถใช้งานร่วมกับอุปกรณ์คอมพิวเตอร์ของท่านได้ เว็ปไซต์หรือเซิร์ฟเวอร์จะปฏิบัติการโดยปราศจากข้อผิดพลาด หรือ ไวรัสคอมพิวเตอร์ วอร์ม หรือ ม้าทรอจัน (Trojan Horse) บริษัทฯไม่จะรับผิดชอบชดใช้ต่อความเสียหายใดๆที่ท่านได้ประสบซึ่งเป็นผลมาจากตัวทำลายเหล่านั้น
บริษัทฯจะไม่รับผิดชอบสำหรับเนื้อหาที่จัดทำโดยบุคคลภายนอก และไม่รับผิดชอบต่อความน่าเชื่อถือ หรือ ความมีอยู่อย่างต่อเนื่องของสายโทรศัพท์ หรือ อุปกรณ์ที่ท่านใช้งานเพื่อเข้าสู่เว็ปไซต์
ข้อกำหนดการใช้เหล่านี้จะไม่มีผลกระทบต่อสิทธิตามประมวลกฎหมาย หรือสิทธิที่มีอยู่ตามกฎหมายคุ้มครองผู้บริโภค
ข้อจำกัดความรับผิด
ท่านรับทราบว่าการใช้งานเว็ปไซต์นี้ รวมถึงเนื้อหาบนเว็ปไซต์เป็นความเสี่ยงภัยของตัวท่านเองทั้งสิ้น หากท่านไม่พอใจกับเว็ปไซต์ ข้อกำหนดการใช้ หรือ เนื้อหาที่จะสามารถชดใช้เยียวยาให้ท่านได้ คือการที่ท่านเลิกใช้งานเว็ปไซต์เท่านั้น
เว้นไว้แต่เรื่องที่เกี่ยวกับการฉ้อโกง หรือการเจ็บป่วย หรือ ความตายของผู้ใช้ที่เกิดจากความประมาทเลินเล่อของบริษัทฯ บริษัทฯจะไม่รับผิดชอบไม่ว่าในสถานการณ์ใดๆต่อท่าน หรือ บุคคลอื่นสำหรับ ความเสียหายโดยตรง ความเสียพิเศษ ความเสียหายทางอ้อม ผลที่ตามมา หรือ ค่าใช้จ่ายอื่นๆที่เกี่ยวกับความเสียหายทั้งหมดทั้งสิ้น ค่าเสียหายเชิงลงโทษ หรือ ความสูญเสียผลกำไร หรือความเสียหายอื่นไม่ว่ารูปแบบใดๆ ไม่ว่าจะเกิดขึ้นจากการรับรอง ข้อสัญญา การละเมิด (รวมถึงความประมาทเลินเล่อ) หรืออื่นใด ถึงแม้ว่าบริษัทฯจะได้รับการแจ้งเตือนเกี่ยวกับความเป็นไปได้ในการเกิดเหตุการณ์เหล่านั้นก็ตามเกี่ยวกับการใช้งานของท่านบนเว็ปไซต์ กฎหมายที่ใช้บังคับอาจไม่อนุญาตข้อจำกัด หรือ ข้อยกเว้นความรับผิดชอบเกี่ยวกับ ความเสียหายที่ผลที่ตามมา หรือค่าใช้จ่ายที่เกี่ยวข้องกับความเสียหาย ดังนั้นข้อจำกัดหรือข้อยกเว้นอาจไม่ใช้บังคับกับท่าน
ข้อจำกัดความรับผิด
ท่านยอมรับว่า บริษัทฯสงวนสิทธิในการเปลี่ยนแปลงเนื้อหา หรือคุณสมบัติทางเทคนิคที่เกี่ยวข้องกับเว็ปไซต์ได้ตลอดเวลาตามที่บริษัทฯเห็นสมควร ท่านตกลงยอมรับอีกว่าการเปลี่ยนแปลงดังกล่าวอาจเป็นผลทำให้ท่านไม่สามารถเข้าใช้งานเว็ปไซต์ได้
ข้อจำกัดความรับผิด
ท่านตกลงว่าจะรับผิดชดใช้ ป้องกัน และ ไม่ทำอันตรายแก่บริษัทฯ พนักงาน ผู้แทน และ ตัวแทนของบริษัทฯจากข้อร้องเรียน การดำเนินการตามกฎหมาย ข้อเรียกร้อง หรือกระบวนการอื่นที่ยกขึ้นสู้กับบริษัทฯ พนักงาน ผู้แทน และ ตัวแทนของบริษัทฯ ที่ยกขึ้นมาจากบุคคลที่สาม ตามขอบเขตแห่งการเรียกร้อง คดีความ การดำเนินการ หรือกระบวนการใดๆ ที่ยกขึ้นสู้กับบริษัทฯ พนักงาน ผู้แทน ผู้ขาย หรือ ตัวแทนของบริษัทฯ โดยมีเหตุอันเกี่ยวเนื่องมาจาก
- (ก) การใช้งานเว็ปไซต์ของท่าน
-
(ข) การฝ่าฝืนข้อกำหนดการใช้งานของท่าน
- (1) ละเมิดสิทธิในทรัพย์สินทางปัญญาของผู้อื่น หรือ สิทธิส่วนบุคคล หรือสิทธิอันเป็นสาธารณะอื่นๆ
- (2) เป็นการใส่ร้าย หรือหมื่นประมาท หรือกระทำการอื่นอันเป็นผลให้เกิดความเจ็บป่วย หรือความเสียหายแก่บุคคลอื่น
- (ง) การลบ การเพิ่มเติม การเติมเข้าไป การเปลี่ยนแปลง หรือการใช้งานโดยไม่ได้รับอนุญาตจากเว็ปไซต์โดยตัวท่าน หรือ
- (จ) การแถลงข้อความเป็นเท็จ หรือการละเมิดการรับรอง หรือ การรับประกันโดยตัวท่านทำขึ้นมาเอง การอ้างถึงข้อกำหนดการใช้ในข้อนี้เกี่ยวกับการใช้งานเว็ปไซต์ของท่าน ให้รวมไปถึงการใช้งานโดยบุคคลอื่นที่บุคคลอื่นเข้าสู่เว็ปไซต์นี้โดยใช้เครื่องคอมพิวเตอร์ของท่าน ท่านตกลงชดใช้ให้แก่บริษัทฯ พนักงาน ผู้แทน และตัวแทนของบริษัทฯ สำหรับค่าใช้จ่าย ความเสียหาย และความสูญเสีย (รวมถึง ค่าที่ปรึกษากฎหมายอย่างสมเหตุสมผล) ปูนบำเหน็จให้แก่บริษัทฯ พนักงาน ผู้แทน และตัวแทนของบริษัทฯ หรือการอื่นอันก่อให้เกิดแก่ บริษัทฯ พนักงาน ผู้แทน และตัวแทนของบริษัทฯ อันเกี่ยวข้องกับ หรือ เป็นผลมาจากข้อเรียกร้อง การฟ้องร้อง การดำเนินคดี กระบวนการพิจาราณาของบุคคลอื่นด้วย
การถ่ายโอนและผลตอบสนองของข้อมูล
ข้อมูลใดๆที่ท่านได้ถ่ายโอนผ่านเว็ปไซต์นั้นให้เป็นไปตามนโยบายความเป็นส่วนตัวของบริษัทฯ และถือเป็นทรัพย์สินของบริษัทฯด้วย ห้ามมิให้ท่านทำการโอนถ่ายไปสู่ หรือนำออกจากเว็ปไซต์ไปกระทำการผิดกฎหมาย ข่มขู่ ใส่ร้าย หมิ่นประมาท ทำการอนาจาร หรือทำเป็นเนื้อหาลามก หรือเนื้อหาอื่นใดที่สามารถทำให้เกิดความรับผิดตามกฎหมายไม่ว่าจะเป็นกฎหมายแพ่งหรืออาญา
ท่านตกลงว่าบริษัทฯอาจใช้ และ/หรือ เปิดเผยข้อมูลเกี่ยวกับภูมิศาสตร์และการใช้งานของเว็ปไซต์เป็นไปในทางที่ไม่เปิดเผยตัวตนของท่านได้
กฎหมายท้องถิ่นและกฏข้อบังคับ
เว็ปไซต์นี้มิได้มีไว้สำหรับทุกคนในทุกๆเขตอำนาจที่ซึ่งการเผยแพร่สิ่งพิมพ์หรือความคงอยู่ของเว็ปไซต์นั้นเป็นสิ่งต้องห้าม ดังนั้นผู้ซึ่งอยู่ภายใต้กฎข้อห้ามที่มีผลใช้บังคับอยู่เหล่านั้น ห้ามเข้าสู่เว็ปไซต์
บริษัทฯไม่รับรองว่า เว็ปไซต์หรือเนื้อหาของเว็ปไซต์นั้นเหมาะสมกับกรใช้หรือได้รับอนุญาตตามกฎหมายของท้องถิ่นที่ในทุกเขตอำนาจ ดังนั้นผู้ที่เข้าใช้งานเว็ปไซต์นั้น เข้าใช้งานด้วยความตั้งใจของตนเอง และต้องรับผิดชอบในการปฏิบัติตามกฎหมายหรือข้อบังคับที่เกี่ยวข้อง การหารือข้อกฎหมายเป็นสิ่งที่ควรทำในกรณีที่เกิดข้อสงสัย
การยกเลิกสิ้นสุด
ไม่ว่าท่าน หรือ บริษัทฯอาจยกเลิกข้อกำหนดการใช้เหล่านี้ได้ โดยที่มีหรือไม่มีสาเหตุได้ตลอดเวลา หากบริษัทฯยกเลิกข้อกำหนดการใช้นี้ บริษัทฯจะอีเมลล์แจ้งให้ท่านตามที่อยู่อีเมลล์ที่ท่านกรอกตอนลงทะเบียน และให้ถือว่าท่านได้รับจดหมายอีเมลล์นั้นภายในหนึ่งชั่วโมงนับจากการโอนถ่ายข้อมูล การยกเลิกสิ้นสุดให้มีผล ณ ขณะนั้นทันที ท่านจะต้องรับผิดชอบในการแจ้งการเปลี่ยนแปลงที่อยู่อีเมลล์ของท่านให้แก่บริษัทฯทราบ ท่านอาจยกเลิกสิ้นสุดได้โดยการยกเลิกการเป็นสมาชิก ณ ขณะที่ท่านยกเลิกสิ้นสุดนั้น ท่านต้องทำลายเนื้อหาทั้งหมด และสำเนาที่เกี่ยวข้องที่ได้รับมาจากการใช้งานเว็ปไซต์ด้วย
การแยกออกจากกันได้และการสละสิทธิ์
หากข้อกำหนดใดในสัญญาฉบับนี้มีผลเป็นโมฆะต่อศาลที่มีเขตอำนาจ ความเป็นโมฆะของข้อบัญญัติข้อนั้นจะไม่มีผลกระทบต่อข้อบังคับอื่นที่เหลืออยู่ของสัญญา ซึ่งให้มีผลบังคับใช้ได้เต็มที่ตามเดิม การสละสิทธิ์การบังคับใช้ข้อกำหนดข้อใดข้อหนึ่งไม่ถือว่าเป็นการสละสิทธิ์ในข้อกำหนดอื่นๆด้วย
สิทธิของบุคคลที่สาม
ข้อกำหนดการใช้ฉบับนี้มิได้มีความตั้งใจในการกล่าวอ้างถึงบุคคลที่สาม (ไม่ว่าจะเป็นการอ้างถึงไว้ในข้อกำหนดการใช้ฉบับนี้ โดยชื่อ ชั้น คำบรรยาย หรืออื่นใด) ในการให้สิทธิประโยชน์ หรือสิทธิ (ภายใต้ข้อตกลงว่าด้วยสิทธิแห่งบุคคลที่สาม) ตามกฎหมายหรืออื่นๆที่กำหนดไว้) ที่บังคับไว้ภายใต้ข้อกำหนดนี้หรือข้อตกลงอื่นๆที่อาจจะมีขึ้นเกี่ยวข้องกัน
สัญญาทั้งฉบับ
เว้นแต่ที่กำหนดไว้ในข้อกำหนดการใช้ฉบับนี้ ข้อกำหนดและเงื่อนไขเป็นข้อตกลงระหว่างบริษัทฯกับท่านและให้มีผลลบล้างความเข้าใจ หรือ ข้อตกลงอื่นๆ (ไม่ว่าจะเป็นลายลักษณ์อักษร หรือ วาจา)ที่มีมาก่อน ข้อกำหนดในข้อนี้ไม่มีผลเป็นการจำกัด หรือ ยกเว้นความรับผิดของคู่สัญญาเกี่ยวกับการฉ้อโกง
กฎหมายที่ใช้บังคับและเขตอำนาจ
ข้อกำหนดการใช้ฉบับนี้ให้กฎหมายไทยเป็นกฎหมายบังคับใช้ และคู่สัญญาตกลงยื่นข้อเรียกร้องของตนในศาลไทยที่มีเขตอำนาจ
